Liability waiver

Foil sports, wake sports, efoiling, wing foiling, pump foiling, dock starts, wake surfing, boating, swimming, and related activities involve inherent risks. These risks may include falls, collisions, changing water and weather conditions, equipment malfunction, contact with vessels or fixed objects, and serious injury or death.

By participating, you voluntarily choose to take part and accept the risks associated with these activities, whether known or unknown, including risks that may arise from the actions of other participants, instructors, boat operators, or conditions on the water.

You confirm that you are physically able to participate and have disclosed any relevant medical conditions, injuries, allergies, or limitations to Elevate Foilsports before your session. You agree to stop participating and notify your instructor if you feel unwell, unsafe, or unable to continue.

To the fullest extent permitted by law, you release and hold harmless Elevate Foilsports, its owners, instructors, contractors, boat operators, and representatives from claims, demands, damages, or liability arising from your participation, except where prohibited by applicable law.

This release includes claims connected to ordinary negligence, instruction, equipment use, transportation on or near the water, and the acts or omissions of other participants.

You agree to follow all safety instructions, wear required safety equipment, respect waterway rules, and use equipment only as directed. Elevate Foilsports may pause or end participation when conditions, equipment, conduct, or safety concerns make continuing inappropriate.

A parent or legal guardian must review and accept this agreement for any participant under the age of 18. The parent or legal guardian confirms they have authority to do so and accepts responsibility for the minor’s participation.

Elevate Foilsports may capture photos or video during sessions for coaching, safety review, and promotional use. Tell your instructor before the session if you do not consent to promotional use of your image.

By booking or participating in a session, you confirm that you have read and understood this waiver, have had the opportunity to ask questions, and agree to its terms voluntarily.
